These terms are an agreement between you and Tech Teki LLC ("Tech Teki", "we", "us") for your use of Teki Analytics at analytics.techteki.com (the "Service"). By creating an account or using the Service, you agree to these terms. If you use the Service for an organization, you agree on its behalf and confirm you have authority to do so.
1. The Service
Teki Analytics measures visits to websites you own or manage. You add a tracking code to your website, and the Service records pageviews, visitor sessions and, depending on your plan, events, goals, heatmaps and session recordings. We may improve, change or stop features over time. We will give reasonable notice before removing a feature you pay for.
2. Your account
You must give accurate sign-up information, keep your password secure, and be at least 18 years old. You are responsible for activity under your account. Tell us at [email protected] if you suspect unauthorized access.
3. Websites you track
You may only add tracking to websites you own or are authorized to manage. You are responsible for your website's visitors' privacy: you must tell them about analytics in your own privacy policy and obtain any consent your laws require, for example for session recordings or for visitors in the EU or UK. You must not use the Service to collect passwords, payment card numbers, health information or other sensitive personal data. Session recordings hide form fields by default; do not turn this off for sensitive fields.
4. Acceptable use
You must not: use the Service for unlawful tracking or surveillance; try to access other customers' data; overload, probe or attack the Service; resell the Service without our written permission; or send fake traffic to manipulate statistics. We may suspend accounts that break these rules.
5. Plans, payment and renewal
Paid plans are billed in advance, monthly or yearly, through PayPal, and renew automatically until cancelled. You can cancel at any time from your account; your plan stays active until the end of the period you paid for. Except where the law requires otherwise, payments are not refundable. Trial plans convert to paid only if you choose a paid plan. We may change prices with at least 30 days' notice by email; the new price applies from your next renewal. If a payment fails or a plan expires, your account moves to the Free plan and its limits.
6. Usage limits
Each plan has limits, such as websites, pageviews per month and how long data is kept. If a website reaches its monthly limit, tracking for that website pauses until the next month or until you upgrade. Data older than your plan's retention period is deleted automatically.
7. Your data
The analytics data collected for your websites belongs to you. We process it only to provide the Service, as described in our Privacy Policy. You can export it, where your plan allows, and delete it at any time. When you delete your account, your websites and their data are deleted within 30 days, except where we must keep records by law.
8. Availability
We work to keep the Service available but do not guarantee uninterrupted service. Planned maintenance, outages at our hosting provider and events outside our control may interrupt tracking. Missed tracking during an outage cannot be recovered.
9. Warranties and liability
The Service is provided "as is". To the fullest extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential losses, such as lost profits or lost data.
10. Ending the agreement
You can stop using the Service and delete your account at any time. We may suspend or end your account if you break these terms, with notice where reasonable.
11. Changes to these terms
We may update these terms. We will post the new version here and, for material changes, email account holders at least 14 days before they take effect.
12. Governing law
These terms are governed by the laws of the State of [New Jersey], USA. Disputes will be resolved in the courts of [county], [New Jersey].
